WHAT IS LOOPING?

Looping is a method that cannabis buyers use in an attempt to get around Colorado’s transaction limits at a marijuana dispensary, which states in the Retail Marijuana Code Rule R 402 Subparagraph (C)(1.5),

“A Retail Marijuana Store and its employees are prohibited from selling more than one ounce of Retail Marijuana flower or its equivalent in Retail Marijuana Concentrate or Retail Marijuana Product during a sales transaction to a Colorado resident.”

Buyers will ‘loop’ around the block after making a purchase and then return to the store for a second purchase at the same dispensary just a bit later. When these dedicated individuals are successful they are then able to posses over the legal weight limit specified in cannabis compliance law.

WHO IS LIABLE?

It seems that law enforcement officials are treating the individuals who actually execute these ‘looped’ sales as being responsible – meaning your budtenders could quite literally be placing their personal freedom on the line and should be trained and equipped to recognize and prevent ‘looping’ before it occurs.

The future remains to be seen if whether or not this will hold true. Dispensary managers, owners, or investors could also in the future face legal consequences related to violating marijuana dispensary transaction limits.

These individuals could also see their license to operate revoked for failure to follow marijuana dispensary transaction limits in their municipality regardless of their potential criminal legal liability.
